04Your Account

  • You must be at least 18 years old and have full legal capacity to use the Service. The Service is not intended for minors.
  • You agree to provide real, accurate and up-to-date information when you create your Account and to update it when it changes.
  • You are responsible for keeping your password confidential and for all activity carried out from your Account. Use a strong password that you do not use for other services, and do not share it with anyone.
  • If you notice unauthorised use of your Account or suspect that your password has been compromised, let us know without delay at [email protected].
  • Your Account is personal. You may not sell, rent or transfer it to another person without the Provider’s written consent.
  • Each person may have one Account. An Account needs its own email address (addresses with a “+” alias are not accepted) and its own mobile phone number; the same email address or phone number cannot be used for a second Account at the same time. After deleting your Account you can sign up again with the same email address or phone number, under the conditions in section 15.
  • Social media accounts are connected through the Third-party Platforms’ own sign-in mechanisms. The Provider does not ask for and does not store the passwords of those accounts.

05Description of the Service

theposting.ai lets you upload one or more images or a video and a short instruction (brief), choose a tone and the networks you want, and receive a post draft for each network, generated with the help of artificial intelligence models.

Uploaded files are stored privately and only become public when you publish them. If you upload more photos than a post can take on your Plan, the Service may choose the photos used and their order automatically, with the help of AI; check the selection before publishing.

On Plans that include this feature you can edit your uploaded photos (colour filters, adjustments and auto enhance). Editing is algorithmic image processing carried out on the Provider’s servers, not artificial intelligence: no new content is generated or added. The original photo is kept and you can go back to it at any time.

Drafts can be edited, regenerated with additional guidance or deleted. No draft is published until you explicitly approve it and start publishing. If you edit a draft after approving it, it becomes a draft again and needs to be approved again.

Publishing takes place on the social media accounts you have connected, through a third-party publishing service and the application programming interfaces (APIs) made available by the Third-party Platforms. Each network is published separately, so an error on one network does not stop publishing on the others. You can publish right away, schedule publishing for a later date and time on Plans that include scheduling, or copy the text and download the files to publish yourself.

The Service shows the status of each publication and, where available, a link to the published post. The Provider does not guarantee that a post will be accepted, displayed or kept by a Third-party Platform.

The features available may differ depending on the Plan you choose.

06Plans, subscription and payment

  • The Service is offered through a free Plan and one or more paid Plans. The features, limits and price of each Plan are those shown on the website at the time you choose or purchase it.
  • The free Plan is available for a limited period of 3 months from the creation of the Account (or another period shown on the website at sign-up); any Trial Period is included in it. After that period, unless you choose a paid Plan, the Account remains accessible for viewing, copying and downloading existing content and for managing billing, but you can no longer create new posts, regenerate drafts or publish and schedule through the Service.
  • To prevent abuse of the free Plan, on the free Plan (including during the Trial Period) you can connect only social media accounts that have not previously been connected to theposting.ai by another User. Such an account can be connected on a paid Plan.
  • Prices are shown and charged in euro (EUR) and include VAT at the 21% rate applicable in Romania. Subscriptions taken out earlier in Romanian lei continue to be billed in lei.
  • Subscriptions are billed on a recurring basis, in advance, for each billing period you choose (monthly or yearly), using the card or other payment method you enter on the payment page.
  • Your Subscription renews automatically at the end of each billing period for a period of the same length, until you cancel it. By activating a Subscription, you authorise the Provider, directly or through the payment processor it uses, to collect the price of each renewal period.
  • You can cancel your Subscription at any time from your Account settings, when that option is available, or by writing to [email protected] from the email address associated with your Account. Cancellation takes effect at the end of the current, already paid billing period. Until then you keep access to the paid Plan’s features; after that, your Account moves to the free Plan, with its limits. If the free Plan period (counted from the creation of the Account) has already ended, the Account remains accessible only for viewing, copying and downloading existing content and for billing, until you choose a paid Plan again. Your posts, drafts and connected social accounts are not deleted when you cancel.
  • You can move to another paid Plan or another billing period at any time. When you switch, the unused value of the old Plan and the cost of the new Plan for the rest of the period are prorated: any amount due is charged immediately, and any difference in your favour remains as a credit balance with the payment processor and is deducted from your next invoices, without being refunded. The new Plan’s limits apply straight away. Monthly packs are kept when you switch Plans; extra social accounts are kept, except when you move to a Plan with unlimited accounts, in which case they end.
  • The Provider may change the prices of its Plans. Any price change is communicated to you in advance, by email or by a notice in the Service, and applies only from the next billing period after the date communicated. If you do not agree with the new price, you can cancel your Subscription before it applies.
  • A Plan's post and regeneration limits apply per one-month period and reset at every subscription renewal (on the same day of the month you started). On the free Plan the period starts on the day of the month you created your Account; during the Trial Period, when the trial started. On yearly Subscriptions the limits reset every month, on the same day of the month.
  • The Plan’s limits (for example the number of posts, regenerations, publications, connected social media accounts or photos per post) are applied automatically. When you reach a limit, that action is no longer available until the period resets, you add an extra pack or you move to another Plan.
  • Where a Plan includes unlimited social media accounts, they are offered within reasonable use, for your own business’s accounts.
  • On paid Plans you can add monthly packs of extra posts or regenerations to your Subscription; they are not available on the free Plan or during the Trial Period. Each pack raises the Plan's limit by the stated number of posts or regenerations in every one-month period, starting with the current one, and is billed recurrently together with the Subscription until you remove it or the Subscription ends. Unused extra posts or regenerations do not carry over to the next period. When you add a pack, the prorated amount for the rest of the current billing period is charged immediately. Packs are kept when you switch Plans. Removing a pack takes effect immediately, without a refund, and cancelling the Subscription ends the packs with it, at the end of the paid billing period.
  • Credits from one-time packs bought before monthly packs were introduced remain valid: they are used only after the limit for the current period is used up and do not expire while your Account exists; they end when the Account is deleted.
  • On paid Plans with a limited number of social media accounts you can add extra social accounts, billed recurrently together with the Subscription. When you add one, the prorated amount for the rest of the current billing period is charged immediately. Reducing the number of extra social accounts takes effect immediately, without a refund, and cancelling the Subscription ends them with it, at the end of the paid billing period.
  • The Provider may, at its discretion, grant free monthly packs, credits or custom offers (for example a Plan or limits agreed individually, following a request sent through the custom offer form). They apply under the conditions and for the duration communicated when they are granted; free packs do not extend the free Plan period. For a custom offer, the conditions agreed in writing prevail.
  • Payments are processed by Stripe, our payment service provider. The Provider does not receive or store your full card details. For each payment the Provider issues an electronic invoice, available in your Account, in the currency of the payment; invoices in euro state the BNR (National Bank of Romania) exchange rate used and the VAT amount in lei, as Romanian tax law requires. You can enter the details shown on the invoice (individual or company, tax ID, address) at checkout or in your Account.
  • If a payment cannot be collected, the payment processor retries the charge automatically, and the Service (Billing page) shows that the payment is overdue and that you can update your payment method. Meanwhile you keep access to the paid Plan. If the payment still fails after the retries, the Subscription ends or is suspended and your Account moves to the free Plan, as on cancellation.

07Trial period and refund policy

Trial Period. The Provider may offer a free Trial Period for paid Plans. Currently, when you create an Account you automatically get 7 days of the Pro Plan, without entering a card. The length and conditions of the Trial Period are those shown at sign-up or when the trial is activated.

At the end of the Trial Period, your Account moves to a paid Plan only if you choose to do so and enter a payment method. Otherwise, your Account moves to the free Plan, at no charge.

No refunds. Except for the right of withdrawal described below, amounts paid for Subscriptions, extra packs and extra social accounts are non-refundable, including for partially used billing periods and for the time remaining after cancellation, except where mandatory applicable law provides otherwise. The free Plan and the Trial Period let you try the Service before you pay.

Right of withdrawal. If you are a Consumer, under Romanian Government Emergency Ordinance (OUG) no. 34/2014 on consumer rights you are, in principle, entitled to withdraw from a distance contract (for example buying a Subscription, switching Plans or adding a monthly pack or extra social accounts), without giving any reason, within 14 days of its conclusion. The Service, however, starts immediately after payment: the limits of the new Plan, pack or extra social accounts apply right away.

Request for immediate start. Before any payment (buying a Subscription, switching Plans, adding monthly packs or extra social accounts), the Service asks you to tick a confirmation by which you expressly request that the supply of the Service begin immediately and acknowledge that, once supply has begun, you lose your 14-day right of withdrawal for the period already begun, in accordance with article 16 of OUG no. 34/2014. Without this confirmation the payment cannot be made. The Provider keeps proof of the confirmation (the date and time, the Plan or extra purchased and the version of these Terms). The free Plan and the Trial Period involve no payment, so you are not asked for this confirmation for them. Automatic renewals of an existing Subscription are not new contracts and do not require a new confirmation.

To the extent that, in a specific situation, the law nevertheless preserves your right of withdrawal, you can exercise it by sending us an unequivocal statement at [email protected] from the email address associated with your Account before the period expires (you may also use the model withdrawal form in Annex 2 to OUG no. 34/2014). In that case we will refund the amounts received within 14 days of receiving your statement, using the same payment method, and may keep an amount proportionate to the services supplied up to the time you informed us of your withdrawal.

This section does not restrict any rights that mandatory law grants you. If you believe that you are entitled to withdraw or to a refund in a specific situation, write to us at [email protected].

08User Content

You keep all the rights you have in your User Content. The Provider does not become the owner of your images, instructions or text.

So that it can provide the Service, you grant the Provider a non-exclusive, royalty-free, worldwide licence, limited to the time necessary, to store, reproduce, technically process (for example resize or convert the format of), transmit to AI model providers and to the publishing service, and publish your User Content, solely to carry out your instructions and to operate the Service. This licence does not allow the Provider to use your Content in its own promotional material or to sell it to third parties.

The licence ends when you delete the content concerned or your Account, except for: content already published on Third-party Platforms, which remains under your control on that platform; the stored copy of the content of a deleted Account, which the Provider only keeps, without using or publishing it, for as long as the Account can be restored (see section 15); and copies kept temporarily in backups or that the Provider is required by law to keep.

You represent and warrant that you hold all the rights, licences and consents needed for your User Content, including:

  • the copyright in, or a licence to use, the images you upload;
  • the consent of any identifiable person shown in the images to the use and publication of their likeness and, for minors, the consent of their parents or legal guardians;
  • the right to use any trademarks, logos and other protected elements that appear in the content.

You are solely responsible for your User Content and for the posts you approve and publish. To the extent permitted by law, you agree to indemnify the Provider for damages and reasonable costs, including legal fees, arising from third-party claims related to your Content or to your breach of these Terms.

The Provider does not review content in advance, but it may remove or disable access to content that breaches these Terms or the law, including after receiving a report.

09AI-generated content

Drafts are generated automatically by artificial intelligence models operated by third-party providers. The results may contain errors, inaccurate or incomplete information, unsuitable wording or incorrect descriptions of your images.

The Service is set up not to invent prices, dates or offers that do not appear in your brief or images, but the Provider cannot guarantee that this will never happen.

You must review every draft before approving and publishing it, including facts, figures, names, links, hashtags and compliance with the law and with the Third-party Platform’s rules. By approving a draft, you adopt its content as your own.

The Provider does not guarantee the originality or uniqueness of AI-generated Content. Similar text may also be generated for other users, and copyright protection for automatically generated text may be limited.

The Provider claims no rights in the drafts generated for you and, to the extent it holds any such rights, assigns them to you so that you can use the drafts freely, in compliance with these Terms.

AI-generated Content is not legal, medical, financial or other professional advice.

10Third-party platforms

To publish, you connect your social media accounts (for example X, LinkedIn, Facebook, Instagram). Your use of those networks is governed by their own terms, policies and rules, which you must comply with, including the types of accounts accepted for publishing (for example Business or Creator accounts on Instagram, Pages on Facebook).

To run the Service, the Provider uses third-party providers that have their own terms and policies: currently, the Zernio service for connecting accounts and publishing posts, the OpenRouter service for access to the AI models that generate drafts, Stripe for payments and Cloudflare for storing uploaded files and for the network through which the website is delivered. The Provider may replace these providers with others offering similar services.

The Provider does not control Third-party Platforms and is not liable for:

  • their outages, errors or unavailability;
  • changes to their APIs, rules or features that limit or stop publishing or draft generation;
  • a platform rejecting, removing, limiting the visibility of or altering your posts;
  • a platform suspending, restricting or closing your accounts.

You can disconnect a social account from the Service at any time. Disconnecting does not delete posts already published; you can manage those directly on the platform concerned.

X, LinkedIn, Facebook, Instagram, Threads, Bluesky, TikTok, Pinterest, YouTube, Snapchat, Reddit, Telegram, Discord, WhatsApp, Slack and Google Business, and the related logos, are trademarks of their respective owners. theposting.ai is not affiliated with, sponsored or endorsed by them.

11Prohibited use

You may not use the Service to:

  • generate or publish content that is illegal, defamatory or discriminatory, that incites hatred or violence, or that harasses or threatens other people;
  • upload sexually explicit material, material that exploits or sexualises minors, or intimate images of a person without their consent;
  • infringe intellectual property rights, image rights or the privacy of others;
  • create deceptive content, such as disinformation, fake reviews, impersonation of a person or organisation, undisclosed advertising or false commercial claims;
  • send spam, mass-publish automatically or engage in any activity that breaches Third-party Platforms’ rules on inauthentic behaviour;
  • attempt to gain unauthorised access to the Service, to other users’ accounts or to the Provider’s infrastructure, or test the Service for vulnerabilities without the Provider’s consent;
  • disrupt the operation of the Service, for example through overloading, malicious code or circumventing a Plan’s usage limits;
  • scrape data, decompile or copy the Service, or use it to build a competing product;
  • resell the Service or make it available to third parties without the Provider’s written consent.

If it detects prohibited use, the Provider may take the measures set out in section 15.

12The Provider’s intellectual property

The Service, including its software, design, interface, website text, and the theposting.ai name and logo, belongs to the Provider or its licensors and is protected by copyright and trademark law.

For as long as your Account exists, the Provider grants you a limited, non-exclusive, non-transferable and revocable right to use the Service in accordance with your chosen Plan and these Terms. You acquire no other rights in the Service.

If you send us suggestions or feedback, the Provider may use them freely to improve the Service, without any obligation to you.

Back to contents

13Availability and changes to the Service

The Provider makes reasonable efforts to keep the Service available and working correctly, but does not guarantee uninterrupted or error-free operation. To the extent permitted by law, the Service is provided “as is” and “as available”.

The Service may be temporarily unavailable for maintenance, updates, security incidents or because of Third-party Platforms. Where possible, planned maintenance is announced in advance.

The Provider may improve, change, add or remove features. If a change significantly reduces the features of a paid Plan you use, we will notify you in advance and you will be able to cancel your Subscription before the change takes effect.

The Provider may permanently discontinue the Service with at least 30 days’ prior notice, in which we will explain how you can save your data. From the announcement onwards, no renewals are charged for periods after the discontinuation, and any rights the law grants you for the paid, unused period remain unaffected.

Back to contents

14Limitation of liability

To the fullest extent permitted by law, the Provider is not liable for indirect damages, such as loss of profit, customers, business opportunities, reputation or data, resulting from the use of or inability to use the Service.

The Provider is not liable for the content you approve and publish, including errors in AI-generated Content that you did not correct before publishing, nor for the acts of Third-party Platforms described in section 10.

To the extent permitted by law, the Provider’s total liability to you for any claim relating to the Service is limited to the total amounts you paid the Provider for the Service in the 12 months before the event giving rise to the claim.

Nothing in these Terms limits or excludes the Provider’s liability for damage caused intentionally or through gross negligence, for death or personal injury, or in any other situation where the law does not allow liability to be limited. If you are a Consumer, your rights under consumer protection law remain unaffected.

Back to contents

15Suspension and termination

You can end your relationship with the Provider at any time by deleting your Account, from the Account page (the “Delete account” section, where you confirm by typing the Account’s email address) or by writing to [email protected] from the email address associated with your Account. Before deletion, we recommend downloading any content you want to keep: after deletion you can no longer access it.

Deletion takes effect immediately: the Account is deactivated, you are signed out on all devices and can no longer sign in to it; scheduled publications are cancelled and nothing more is published from the Account; your connected social accounts are disconnected from the publishing service; any active Subscription is cancelled immediately, with no further renewals; and monthly packs, extra social accounts, remaining credits from one-time packs and any packs or offers granted by the Provider end. Deleting your Account does not entitle you to a refund of amounts already paid, including for the remainder of the current billing period (see section 7), except under the right of withdrawal, if still within its period. Posts already published on Third-party Platforms are not deleted; you can remove them directly on those platforms.

The Provider may suspend or restrict access to your Account, with or without prior notice depending on the seriousness of the situation, if: you breach these Terms, in particular section 11; there is a security or fraud risk; a competent authority requires it; or a payment due has not been made. In the case of serious or repeated breaches, the Provider may close your Account. Where possible and permitted by law, we will tell you the reason and give you the opportunity to respond.

Data after deletion. Deleting your Account does not erase your data straight away. Your Account data, uploaded images and videos, drafts and post history are kept, deactivated and inaccessible to you, so that the Account can be restored at your request and to prevent abuse of the Trial Period and the free Plan. They are kept for as long as the Account can be restored, until you ask us to erase them permanently; the Provider may also delete or anonymise deactivated Accounts at a later date.

Signing up again. After deleting your Account you can sign up again with the same email address or phone number. This creates a new, empty Account. To prevent abuse of the free offer, the new Account does not get a new Trial Period or a new free Plan period: the end dates of the Trial Period and of the free Plan period of the deleted Account (identified by its email address or phone number) carry over to the new Account. Your previous content appears in the new Account only if the Provider restores it at your request.

Restoring the Account. As long as the Account has not been permanently erased, you can ask for it to be restored by writing to [email protected] from the email address associated with the Account. If you have signed up again with the same email address in the meantime, the content of the deleted Account is moved into the new Account, while the billing records (Subscriptions, payments, invoices) remain attached to the old Account, for accounting purposes. Restoring the Account does not reactivate a cancelled Subscription, and social accounts have to be connected again.

Permanent erasure. You can ask at any time, before or after deleting your Account, for your data to be permanently erased (the right to erasure, Article 17 GDPR), by writing to [email protected] from the email address associated with the Account. Permanent erasure is carried out within 30 days of the request, after which the Account can no longer be restored. The following are kept even after permanent erasure: invoices and accounting records, for 10 years under Accounting Law no. 82/1991, without the link to your Account; the proof of the right-of-withdrawal confirmations, together with the billing records; backups, until they are overwritten according to their normal cycle; and the minimal register of connected social media accounts used to prevent abuse of the free Plan, which keeps only a hash of the email address (see the Privacy Policy).

Provisions that by their nature should continue to apply after termination (in particular the warranties and indemnity in section 8, and sections 9, 12, 14 and 18) remain in effect.

16Personal data

The Provider processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and applicable Romanian law. The data processed, the purposes and legal bases of processing, the recipients (including AI model providers and the publishing service), the retention periods and your rights are described in the Provider’s Privacy Policy.

If your images or instructions contain personal data of other people, you are responsible for having a legal basis to upload and publish it and for informing the people concerned.

For questions about personal data or to exercise your rights, you can write to us at [email protected].

Back to contents

17Changes to these Terms

The Provider may change these Terms, for example to reflect changes to the Service, the law or Third-party Platforms. The date of the latest update is shown at the top of this document.

Material changes are communicated to you a reasonable time before they take effect, normally at least 15 days, by email to the address associated with your Account and/or by a notice in the Service. Changes required by law and changes that do not disadvantage you (for example corrections or new features) may take effect immediately.

If you do not agree with the new Terms, you can stop using the Service and delete your Account before they take effect. Continuing to use the Service after that date means you accept the new Terms.

18Governing law and disputes

These Terms are governed by Romanian law.

We will first try to resolve any disagreement amicably. You can write to us at [email protected] and we will reply within a reasonable time.

If a dispute cannot be resolved amicably, it will be settled by the competent courts of Romania. If you are a Consumer, you may also bring proceedings before the court where you are domiciled, and the choice of Romanian law does not deprive you of the protection of the mandatory provisions of the law of the country where you habitually reside.

If you are a Consumer, you also have the following options:

  • you can file a complaint with the Romanian National Authority for Consumer Protection (ANPC) at anpc.ro;
  • you can use alternative dispute resolution (ADR, in Romanian “SAL”) through the ADR entities provided for by Government Ordinance (OG) no. 38/2015; information is available on the ANPC website;
  • for cross-border online disputes within the EU: the European Online Dispute Resolution (ODR) platform, ec.europa.eu/consumers/odr, was closed by the European Commission in July 2025. For help with such disputes you can contact the European Consumer Centre Romania (eccromania.ro).
